UPDATE

Sudbury Police say charges will not be laid at this time against the driver involved in the Falconbridge pedestrian fatal.

Officers identified the driver on Tuesday and collected statements, evidence and video footage which they say showed no wrongdoing on the drivers part and they believe the driver of the dump truck did not know a pedestrian was hit.

At this time charges will not be laid against the driver.

An 86-year old man was pronounced dead at the scene on Monday afternoon after getting hit at the Falconbridge Road and Penman Avenue intersection, his name is being withheld at the request of the family.

The driver involved in the fatal collision on Falconbridge Road in Garson yesterday has been identified.

Sudbury Police sent out images of a dump truck believed to be involved in the collision that took the life of a 86-year old pedestrian, but it turned out it was not the vehicle involved.

Police say the similar looking vehicle was in the area at the time, but the driver came forward to police and they were cleared.

Numerous tips from community members and videos from motor vehicle dash cameras lead to the identification of the actual vehicle involved and the driver has been identified and located.

The investigation is ongoing.
